Thx, It's Not Mine - Rental Service for Petite Women

*Term Changes: We may, at any time and without liability, suspend, modify, or discontinue all or part of the Services (including access to the Site via any third-party links). We also reserve the right to change these Terms at any time by notifying you of such changes by any reasonable means, including by posting the revised Terms on the site.
1. INTRODUCTION
Welcome to "Thx, It's Not Mine" ("Company", "we", "our", or "us"), a specialized designer item rental service catering exclusively to petite women (5'3" and under). These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, and services (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.
2. DEFINITIONS
Full Retail Value is defined in this document as the original retail value stated on our website at the time of your purchase.
2. ELIGIBILITY
To use our Services, you must be of legal age to form a binding contract or, if you are not, that you have obtained parental or guardian consent to enter into these Terms. By using our Services, you represent and warrant that you meet these eligibility requirements.
3. ACCOUNT REGISTRATION
To access certain features of our Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. RENTAL TERMS
4.1 Rental Period
There are two options for the rental period: standard and extended. One option must be selected at the time of checkout to rent an item.
The standard rental period for each item is five (5) days. For example, if the rental start date is Thursday, 8/7/2025, you must return the item on or before August 11th.
The extended rental period for each item is ten (10) days. For example, if the rental start date is Thursday, 8/7/2025, you must return the item on or before Saturday, 8/16/25.
4.2 Shipping/Local Delivery of Rental Item(s)
There are two options to receive your rental item(s). The customer can choose either shipping or, if they are local to Los Angeles and reside within our delivery parameters, opt for local delivery for a fee.
4.3 Return of Rental Item(s)
There is one option for returning the rental item by or on the rental due date. Upon receipt of the rental item, the customer is provided with a pre-paid return label and envelope. The customer will place the rental item in the envelope, fasten the pre-paid return label to the envelope, and drop off the envelope with the designated carrier.
4.4 Returns/Exchanges
We do everything we can to ensure properly fitting rentals for our clients.
To help ensure your rental item fits you, please review the “Size” information listed for every item on our website. You can also contact us at hello@thxitsnotminela.com with size and fit questions.
If you are local to Los Angeles, you can schedule a complimentary “try-on” session and try on the dress at our headquarters in Santa Monica, CA. After placing your order, please contact hello@thxitsnotminela.com to coordinate your complimentary “try-on” session.
If you have had a “try-on” session and, after completing the session, later decide the item isn’t right for you, unfortunately we cannot offer a refund or exchange.
If you have not had a complimentary “try-on” session, you can opt to return the item that does not fit within 24 hours of its arrival to you. Please keep in mind that items that have been worn will not receive a refund. We cannot offer a refund 24 hours after the item arrived due to the nature of the dress rental marketplace.
At this time, we are not able to offer exchanges at all.
4.5 Single Event Use
Each rental is for one event only and for use by one person only. A rented dress that is in your possession may not be lent to another person or worn on multiple occasions, even if worn by the same person. This policy exists because each wearing contributes to the depreciation, risk of damage, and deterioration of the garment. The rental price covers the cost of one occasion, day, or event only. All items are company property and owned by company.
4.6 Rental Pricing
Rental prices are clearly displayed on our website and mobile applications. The price includes the rental period, refundable deposit, and professional dry cleaning services upon return.
4.7 Security Deposit
4.7.1 Deposit Collection
A security deposit of $20.00 is required at the time of rental. The security deposit is included at the time of purchase in the rental “Total.”
4.7.2 Inspection and Deposit Release
Upon return of the dress, we will conduct an inspection within 24-48 hours. If the dress is returned on time and in acceptable condition as outlined in Section 5, the security deposit will be released within 3-5 business days.
4.7.3 Damage Assessment
If damage is identified during inspection, we will:

Document the damage with photographs

Assess repair costs or value depreciation

Notify you via email with documentation and explanation of fees

Charge the payment method on file only the actual damage cost if less than the security deposit

Retain the full security deposit if damage costs exceed the deposit amount

Charge additional fees to the payment method on file beyond the security deposit for severe damage, up to the full retail price of the dress as outlined in Section 6
4.7.4 Communication
You will receive email notifications regarding your security deposit at the following stages:

When your deposit authorization hold is placed

When your returned dress passes inspection and the deposit hold is released

If damage is identified, including documentation and fee explanation
4.8 Payment Methods
We accept major credit cards, debit cards, and other payment methods as specified on our website or mobile applications. By providing a payment method, you represent and warrant that you are authorized to use the designated payment method and that the payment information you provide is true and accurate.
4.9 Late Returns
If you do not return an item(s) by the product return date, you will begin incurring late fees for every day until we receive the item(s). Late returns will incur a late fee of 25% of the original rental price per day, up to the full retail value of the dress. If a dress is not returned within 14 days after the end of the rental period, it will be considered purchased by you at full retail price.
Failure to timely return an item is a violation of our Terms, and we may terminate your account, charge your Payment Method for Late Fees up to the Maximum Late Fee (plus applicable taxes), and/or take other legal action.
5. CONDITION OF ITEMS
5.1 Inspection Period
You are responsible for inspecting the rented dress upon receipt. Any pre-existing damage must be photographed and reported to us via email to hello@thxitsnotminela.com within 24 hours of receiving the dress.
5.2 Alterations
Permanent alterations to rented dresses are strictly prohibited. Temporary adjustment using only fashion tape is permitted, but must not cause damage to the dress. If any alteration to item(s) results in damage, you will be subject to fees in accordance with Section 4.
5.3 Care of Items
While in your possession, you are responsible for the proper care of the rented item(s). The item should be kept away from substances that may cause damage, including but not limited to food, drink, makeup, perfume, deodorant, self-tanner, and other chemicals.
5.4 Return Condition
All rentals include dry cleaning and may be returned uncleaned. However, the item must be free from significant soiling, and all personal items must be removed before returning.
6. DAMAGES AND LIABILITY
6.1 Damage Assessment
All returned items are inspected for damage. If damage is found, we will notify you within three (3) business days of receiving the returned item.
6.2 Minor Damage
Minor damage that does not render the item "unwearable," but decreases its value will result in a fee to cover repairs or reduction in value, as determined by our assessment.
6.3 Significant Damage or Loss
If a dress is damaged beyond repair, deemed "unwearable," or not returned, you will be required to pay for the damages at a value up to the full recommended retail price of the dress. "Unwearable" refers to any condition that would prevent a reasonable person from wearing the dress due to the extent of the damage and is assessed by our team when inspecting the item. If the item is lost, you will be required to pay the full retail value. If the item is lost, you will be required to pay the full retail value.
6.4 Dispute Resolution
If a dispute arises regarding damages or fees, "Thx, It's Not Mine" reserves the right to make the final determination. We will provide documentation of the damage and a detailed explanation of any fees assessed.
7. RETURNS
7.1 Return Methods
Dresses must be returned by the end of the rental period using one of our approved return methods, which may include free drop-off at our physical location(s), a pre-paid return shipping label, or pick-up via courier service for a fee of $15.00.
7.2 Return Confirmation
Upon successful return and inspection of a rented item, we will send you a confirmation email. Please retain this confirmation for your records.
8. CANCELLATIONS AND REFUNDS
8.1 Cancellation Policy
Cancellations made more than 48 hours before the rental start date will receive a full refund. Cancellations made within 48 hours of the rental start date will receive a store credit for the full amount, valid for six months. Cancellations made on or after the rental start date will not receive any type of refund.
8.2 Refund Processing
Refunds will be processed to the original payment method within 5-7 business days.
9. INTELLECTUAL PROPERTY
All content on our Services, including but not limited to text, graphics, logos, images, and software, is the property of "Thx, It's Not Mine" or its licensors and is protected by copyright, trademark, and other intellectual property laws.
10. PRIVACY
Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, explains how we collect, use, and disclose information about you.
11. DISCLAIMER OF WARRANTIES
OUR SERVICES AND ALL CONTENT AND ITEMS AVAILABLE THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
Thx, It’s not Mine will not be responsible or liable for the accuracy, copyright compliance, legality, or decency of material contained in or accessed through the Services or any claims, actions, suits procedures, costs, expenses, damages, or liabilities arising out of or in any way related to your participation in or use of the Services. We make no warranty that the items or Services will meet your requirements, or that the Services will be uninterrupted, timely, secure, or error free; nor do we make any warranty as to the results that may be obtained from the use of the items, or Services, or that defects in the items or Services will be corrected. The Services may become unavailable due to maintenance or malfunction of computer equipment or other reasons. You understand and agree that you will be solely responsible for any damage to your computer or loss of data that results from the download of any material in any way related to the Services and/or our Content. No advice or information, whether oral or written, obtained by you from us through the Services or otherwise will create any warranty, representation, or guarantee not expressly stated in these Terms.
12. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, "THX, IT'S NOT MINE" SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
13. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless "Thx, It's Not Mine" and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees arising from your use of our Services or violation of these Terms.
14. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of The United States, without regard to its conflict of law principles. Any legal suit, action, claim or proceeding arising out of or related to these Terms or our Services will be subject to arbitration under United States arbitration laws.
15. CHANGES TO TERMS
Term Changes: We may, at any time and without liability, suspend, modify, or discontinue all or part of the Services (including access to the Site via any third-party links). We also reserve the right to change these Terms at any time by notifying you of such changes by any reasonable means, including by posting the revised Terms on the site.
16. TERMINATION
We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
17. SEVERABILITY
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
18. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference herein, constitute the entire agreement between you and "Thx, It's Not Mine" concerning our Services.
